UC Law joins Oceana Philippines and PEJC

UC Law joins Oceana Philippines and PEJC in celebrating Oposa v. Factoran Ruling’s 27th year anniversary

Oceana Philippines, in partnership with the Philippine Earth Justice Center, Inc. (PEJC) and the University of Cebu School of Law, will hold a webinar entitled “27 Years of the Oposa v. Factoran Ruling: A Legacy for our Children and the Future Generations” on July 30, 2020 at 9:30 A.M, in celebration of the 27th anniversary of the Oposa v. Factoran Decision.

In Oposa v. Factoran, G.R. No. 101083, July 30, 1993, the Supreme Court (SC) issued the landmark decision which introduced the Doctrine of Intergenerational Responsibility. 

In upholding the legal standing of the minors to file the petition as well as their right to represent not just their generation but also the generations yet unborn, the SC ruled:

“Petitioners minors assert that they represent their generation as well as generations yet unborn. xxx Their personality to sue in behalf of the succeeding generations can only be based on the concept of intergenerational responsibility insofar as the right to a balanced and healthful ecology is concerned. Such a right, as hereinafter expounded, considers

the “rhythm and harmony of nature.” xxx Needless to say, EVERY GENERATION HAS A RESPONSIBILITY TO THE NEXT TO PRESERVE THAT RHYTHM AND HARMONY FOR THE FULL ENJOYMENT OF A BALANCED AND HEALTHFUL ECOLOGY. xxx” [Emphasis supplied]
